Am I entitled to full pay during garden leave?
Yes. You must receive your full contractual salary and benefits throughout garden leave. Your employer cannot reduce your pay or remove benefits during this period — doing so is an unlawful deduction from wages and a breach of contract.
Can my employer force me onto garden leave?
Only if your employment contract contains a garden leave clause. Without a contractual right to require garden leave, your employer cannot force you to stay away from work — you would be entitled to attend and perform your duties during your notice period. Check your contract carefully.
Can I work for another employer during garden leave?
This depends on your contract. Most garden leave clauses prohibit working for a competitor. Working for a completely unrelated employer may be permitted, but your contract may contain a general prohibition on secondary employment. Check your contract before accepting any work.
Does garden leave count as part of my notice period?
Yes. Garden leave runs concurrently with your notice period — it is simply the way your notice is being served. Your employment ends at the end of your notice period regardless of whether you spent it working or on garden leave.
What happens to my holiday during garden leave?
You continue to accrue holiday entitlement during garden leave. Your employer may require you to take any accrued holiday during the garden leave period — check your contract. Any unused holiday remaining at the end of your employment must be paid out on your final day.
Can I negotiate to end garden leave early?
Yes — both sides can agree to end the garden leave period early by mutual consent. Your employer may agree to this if they have filled your role or have no concern about you joining a competitor. Early release is often negotiated as part of a settlement agreement.
